1. Allgemeines

1.1. Diese allgemeinen Geschäftsbedingungen („AGB“) finden Anwendung auf Bestellungen, Verkäufe und Lieferungen von Produkten („Produkte“), die in diesem Webshop („Webshop“) über die Webseite Citycobra.hm-c.at angeboten und vertrieben werden.

1.2. Vertragssprache ist Deutsch.

2. Geltungsbereich

2.1. Diese AGB sind anwendbar, wenn es sich bei dem Käufer um einen Verbraucher im Sinne des § 1 KSchG (Konsumentenschutzgesetz) handelt („Kunde“).

3. Änderungen der AGB

3.1. Dem Anbieter bleibt die Änderung dieser AGB vorbehalten. Für den Verkauf von Produkten gelten die zum Zeitpunkt des Kaufabschlusses jeweils geltenden AGB.

4. Kundenkonto

4.1. Zur Bestellung von Produkten kann der Kunde im Webshop ein Kundenkonto anlegen. Die Erstellung des Kundenkontos erfordert die Angabe gewisser Informationen durch den Kunden. Eine Bestellung ist auch ohne Kundenkonto möglich.

5. Bestellung, Bestellbestätigung, Versandbestätigung

5.1. Der Bestellvorgang erfolgt in folgenden Schritten:

1. Auswahl der gewünschten Ware.

2. Einlegen der Ware in den Warenkorb.

3. Eingabe der persönlichen Daten.

4. Auswahl der Zahlungsmethode und Liefermethode.

5. Nochmalige Prüfung und ggf. Berichtigung der Bestellung.

6. Verbindliches Absenden der Bestellung durch Klick auf „Zahlungspflichtig bestellen”.

5.2. Die im Webshop abgebildeten Produkte und Preisangaben stellen eine Einladung an den Kunden dar, ein verbindliches Angebot über den Erwerb der Produkte an den Anbieter zu richten („Bestellung“). Abbildungen und Zeichnungen der Ware gelten nur als Annäherungswerte, sofern diese beim Produkt nicht ausdrücklich als Fixwert angegeben wurden.

5.3. Der Anbieter wird dem Kunden an die von ihm angegebene E-Mail-Adresse unverzüglich eine Bestätigung senden, dass die Bestellung beim Anbieter eingelangt ist („Bestellbestätigung“). Diese stellt noch keine Annahme des Angebots dar.

5.4. Die Annahme erfolgt je nach gewählter Zahlungsmethode durch Übermittlung einer Auftragsbestätigung per E-Mail, durch Versand der Ware oder durch Übermittlung einer Zahlungsaufforderung.

5.5. Der Kunde hat sicherzustellen, dass sämtliche Informationen (insbesondere Versanddaten) zutreffend und aktuell sind.

5.6. Der Kunde stimmt dem Erhalt einer elektronischen Rechnung zu.

6. Zahlungsmodalitäten

6.1. Alle angegebenen Preise verstehen sich in Euro inklusive Umsatzsteuer, jedoch exklusive Versandkosten. 6.2. Die Bezahlung kann über Vorkasse oder Kreditkarte erfolgen. 6.3. Die Versandkosten werden vor Abgabe der Bestellung sowie in der Bestellbestätigung ausgewiesen.

7. Lieferung

7.1. Dem Kunden stehen die im Webshop genannten Versendungsarten zur Verfügung. 7.2. Die Lieferung erfolgt spätestens 30 Tage ab Vertragsschluss, sofern nicht anders angegeben.

8. Eigentumsvorbehalt

8.1. Der Anbieter behält sich das Eigentum an den Produkten bis zur vollständigen Zahlung des Kaufpreises und der Nebenkosten vor.

9. Verzug des Anbieters

9.1. Gerät der Anbieter in Verzug, hat der Kunde eine angemessene Nachfrist von zwei Wochen zu setzen. Leistet der Anbieter nicht innerhalb dieser Frist, kann der Kunde vom Vertrag zurücktreten.

10. Gewährleistung

11. Haftung und Schadenersatz

12. Allgemeine Bestimmungen

12.1. Es gilt ausschließlich österreichisches Recht unter Ausschluss des UN-Kaufrechts. 12.2. Bei Verbrauchern gilt diese Rechtswahl nur insoweit, als nicht zwingende Bestimmungen des Staates des gewöhnlichen Aufenthalts entgegenstehen. 12.3.
